1. Introduction and Acceptance of Terms

Welcome to DEUCE. The DEUCE websites, mobile applications, and related services (collectively, the "Services") are provided to you by Deuce League Sdn. Bhd. (Company No. 1623072-U), a company incorporated in Malaysia with its registered address at 19 Jalan TSB 6, Taman Industri Sungai Buloh, 47000 Sungai Buloh, Selangor, Malaysia. ("DEUCE," "we," "us," or "our"). These Terms of Service (the "Terms") govern your access to and use of the Services.

By creating an account, clicking "Sign Up," or otherwise accessing or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

These Terms, together with our Privacy Policy, League Rules (as published within the app from time to time), and any other supplemental terms we make available, form the complete agreement between you and DEUCE regarding your use of the Services. In the event of any conflict or inconsistency between these Terms and the League Rules or any other supplemental terms, these Terms shall prevail to the extent of the conflict.

We may update these Terms from time to time. If we make material changes, we will notify you via the app or by email. Your continued use of the Services after such notification constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the Services.

2. Eligibility and Account Registration

2.1 Eligibility

The Services are available to individuals as follows:

If you are 18 years of age or older, you may create an account and use the Services independently.

If you are between 16 and 17 years of age, you may only create an account and use the Services with the consent and ongoing supervision of a parent or legal guardian. Your parent or guardian must review and accept these Terms on your behalf and assumes full responsibility for your use of the Services, including any financial obligations, compliance with these Terms, and all obligations arising from league participation (including financial obligations under the League Rules such as court cost sharing). By registering for a league, a player aged 16 or 17 represents that their parent or legal guardian has also reviewed the applicable League Rules and consents to the player's participation.

If you are under 16 years of age, you may not create an account or use the Services.

By creating an account, you represent and warrant that you meet the applicable age requirements above. DEUCE reserves the right to request proof of age or parental consent at any time and to suspend or terminate any account where such proof is not provided to our reasonable satisfaction.

2.2 Account Registration

To use the Services, you must register for an account. You agree to:

  • Provide true, accurate, current, and complete information about yourself during registration;

  • Maintain and promptly update your account information to keep it accurate and current;

  • Maintain the confidentiality of your password and restrict access to your account; and

  • Accept responsibility for all activities that occur under your account.

You may register using a third-party authentication service (such as Google or Apple). By doing so, you authorise DEUCE to access and use the information provided by that service in accordance with our Privacy Policy.

DEUCE reserves the right to suspend or terminate any account if we have reasonable grounds to believe that any information provided is inaccurate, misleading, or incomplete, or that the account is being used in violation of these Terms.

2.3 One Account Per Person

Each individual may only maintain one active DEUCE account. Creating multiple accounts to manipulate ratings, standings, or league outcomes is strictly prohibited and may result in immediate termination of all associated accounts.

3. Description of Services

DEUCE provides an organised league competition platform for sport players. DEUCE organises and administers league seasons, including division placement, rule enforcement, standings management, and conduct oversight. The Services include, but are not limited to:

  • League management for Tennis, Padel, and Pickleball, including division placement, match scheduling coordination, and standings tracking;

  • The DEUCE Match Rating (DMR) system, which calculates and updates player skill ratings based on match results;

  • Leaderboards and standings based on the Best 6 Results system;

  • In-app messaging for match coordination between league participants;

  • A social feed for sharing match results, updates, and community content;

  • Player profiles displaying ratings, match history, and league statistics; and

  • Skill assessment questionnaires for initial rating placement.

While DEUCE organises and administers league competitions, players are responsible for arranging their own individual matches, selecting and booking courts, and assessing their own fitness to play. DEUCE does not own or operate any sports venues and does not provide coaching, training, or medical advice.

4. DEUCE Match Rating (DMR) System

The DMR is an algorithmic rating system that estimates a player's relative skill level based on match results, score margins, and other factors. You acknowledge and agree that:

  • The DMR is an estimate and not a certified, verified, or guaranteed measure of your actual playing ability;

  • Ratings may fluctuate based on match results, opponent strength, and algorithmic adjustments;

  • DEUCE does not verify the identity, qualifications, or actual skill level of any player;

  • The DMR system, its methodology, algorithms, and all related intellectual property are owned exclusively by DEUCE;

  • DEUCE reserves the right to modify the rating system, recalculate ratings, or reset ratings at any time and for any reason; and

  • For Pickleball players, DUPR ratings provided during onboarding are self-reported and used only as a starting reference. DEUCE does not verify DUPR ratings with any third party.

You shall not represent your DMR as an official certification or use it for any purpose outside of the DEUCE platform without our prior written consent.

5. League Rules and Fair Play

5.1 League Participation

By joining a league, you agree to abide by the League Rules applicable to that league, as published within the app. League Rules may include, without limitation, rules relating to match formats, scoring, the Best 6 Results system, tiebreaker procedures, and season structure.

5.2 Honest Score Reporting

Match results must be accurately reported by both players. Both players are required to confirm or dispute a submitted match result within the app within the timeframe specified in the League Rules. If a player fails to confirm or dispute a submitted result within the specified period, the result shall be deemed confirmed and binding. Deliberately submitting false, inaccurate, or misleading match scores is a serious violation of these Terms and may result in:

  • Reversal or deletion of the affected match result;

  • Adjustment or reset of your DMR rating;

  • Suspension from the current league season; and/or

  • Permanent termination of your account.

5.3 Match Scheduling and Conduct

Players are responsible for arranging their own matches within the league season timeframe. You agree to:

  • Make reasonable efforts to schedule and complete your league matches;

  • Communicate promptly and respectfully with opponents regarding match arrangements;

  • Arrive on time for confirmed matches; and

  • Conduct yourself in a sportsmanlike manner before, during, and after matches.

5.4 Prohibited Conduct in Leagues

The following conduct is strictly prohibited and may result in suspension or termination:

  • Colluding with another player to manipulate match results or ratings;

  • Intentionally losing (tanking) to manipulate standings or ratings;

  • Refusing to confirm legitimate match results;

  • Harassing, threatening, or intimidating opponents or other league participants;

  • Repeatedly failing to honour confirmed match appointments without reasonable cause; and

  • Any other conduct that DEUCE reasonably determines undermines the integrity of the league.

5.5 Financial Obligations in Leagues

By participating in a league, you agree to comply with all financial obligations described in the League Rules, including but not limited to the sharing of court booking costs and reimbursement obligations arising from cancellations or no-shows. Failure to meet these financial obligations within the timeframes specified in the League Rules constitutes a breach of these Terms and may result in withdrawal from the league and suspension from future leagues.

5.6 Procedural Fairness

Before imposing any suspension lasting longer than one league season or any permanent ban, DEUCE will: (a) notify the affected player of the specific allegation or ground for the proposed action; (b) give the player a reasonable opportunity to respond; and (c) communicate the final decision in writing with reasons. This Section does not apply to temporary suspensions of 14 days or less imposed to protect the safety or integrity of the Services pending investigation, or to actions taken at the direction of law enforcement or a government authority.

6. User Content

6.1 Your Content

You own the intellectual property rights in the content you create, upload, post, or share through the Services, including text, photographs, match commentary, and other materials (collectively, "Your Content"). By posting Your Content on or through the Services, you grant DEUCE a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use, display, reproduce, modify (for formatting purposes), and distribute Your Content in connection with operating and providing the Services. This licence ends when you delete Your Content or your account, unless Your Content has been shared with other users who have not deleted it.

6.2 Content Standards

You are solely responsible for Your Content. You agree not to post or share content that:

  • Is false, misleading, defamatory, obscene, abusive, threatening, or harassing;

  • Promotes violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic;

  • Infringes the intellectual property, privacy, or other rights of any third party;

  • Contains viruses, malware, or other harmful code;

  • Is unsolicited advertising, spam, or commercial solicitation; or

  • Violates any applicable law or regulation.

6.3 Content Moderation

DEUCE does not routinely pre-screen or monitor user content but reserves the right to review, remove, or disable access to any content that violates these Terms or is otherwise objectionable, at our sole discretion and without prior notice.

6.4 Feedback

If you provide us with feedback, suggestions, or ideas regarding the Services, you grant DEUCE a perpetual, irrevocable, worldwide, royalty-free licence to use, modify, and incorporate such feedback for any purpose. For this reason, please do not send us feedback that you do not wish to licence to us on these terms.

7. Fees and Payments

Certain features of the Services, including league registration, may require payment of fees. Where applicable:

  • All fees will be clearly communicated before you are required to pay;

  • Fees are payable in Malaysian Ringgit (MYR) unless otherwise stated;

  • Payments may be processed by third-party payment providers, and your use of such services is subject to their terms;

  • All fees are non-refundable unless otherwise stated in a specific refund policy or required by applicable law; and

  • DEUCE reserves the right to introduce, modify, or remove fees for any part of the Services with reasonable prior notice.

8. Acceptable Use and Prohibited Conduct

The Services are for your personal, non-commercial use. You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation;

  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation;

  • Copy, modify, distribute, sell, or create derivative works based on the Services or any content available through the Services (other than Your Content);

  • Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Services or any related software;

  • Use any automated system (including bots, spiders, or scrapers) to access the Services;

  • Collect or harvest any personal information of other users without their consent;

  • Interfere with, disrupt, or place an unreasonable load on the Services or its infrastructure;

  • Attempt to gain unauthorised access to any part of the Services, other accounts, or any systems connected to the Services;

  • Use the Services to send unsolicited communications, advertising, or spam;

  • Circumvent any security measures, access controls, or usage limits of the Services; or

  • Engage in any activity that could damage, disable, or impair the functioning of the Services.

9. Intellectual Property

9.1 DEUCE's Intellectual Property

The Services, including all software, algorithms (including the DMR system), designs, text, graphics, logos, trademarks, and other content provided by DEUCE, are owned by or licensed to Deuce League Sdn. Bhd. and are protected by intellectual property laws. The name "DEUCE," the DEUCE logo, "DMR," "DEUCE Match Rating," and all related marks are trademarks of Deuce League Sdn. Bhd. You may not use these marks without our prior written permission.

9.2 Limited Licence

Subject to your compliance with these Terms, DEUCE grants you a personal, limited, non-exclusive, non-transferable, non-sub-licensable, revocable licence to access and use the Services for your personal, non-commercial purposes. This licence does not include any right to resell, commercially exploit, or distribute the Services or any content therein.

9.3 Copyright Infringement Claims

If you believe that content available on the Services infringes your intellectual property rights, you may submit a notice to us at support@deuceleague.com containing: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material; (c) your contact information; (d) a statement of good faith belief that the use is not authorised; and (e) a statement that the information provided is accurate to the best of the notifier's knowledge.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, storage, and disclosure of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Services, you consent to the processing of your personal data as described in the Privacy Policy.

In accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia and its 2024 amendments, we are committed to:

  • Collecting only personal data that is necessary for the provision of the Services;

  • Processing your personal data lawfully and for the purposes disclosed to you;

  • Maintaining appropriate security measures to protect your personal data;

  • Respecting your rights to access, correct, and withdraw consent for the processing of your personal data; and

  • Notifying you and the relevant authorities in the event of a data breach within the timeframes and in the manner required by applicable law.

11. Interactions with Other Members

DEUCE functions as a platform to connect players for league matches. As a facilitator, DEUCE is not directly involved in the actual interactions, arrangements, or matches between players. You acknowledge and agree that:

  • DEUCE does not verify the identity, background, fitness level, or playing ability of any member;

  • DEUCE has no control over and assumes no responsibility for the conduct of any member, whether on or off the court;

  • You are solely responsible for your interactions with other members, including exercising caution and good judgment when arranging and attending matches; and

  • DEUCE is not responsible for any disputes between members regarding match results, scheduling, conduct, or any other matter.

If you have a concern about another member's conduct, please report it to us through the app or by contacting us at support@deuceleague.com.

12. Electronic Communications

The Services include in-app messaging and a social feed. You agree that:

  • All communications made through the Services are subject to these Terms;

  • You will use the communication features only for purposes related to league participation, match coordination, and community engagement;

  • DEUCE does not routinely monitor communications but reserves the right to review messages in response to reports of violations or as required by law;

  • Communications sent through the Services should not be considered private, and you should not share sensitive personal information through in-app messaging; and

  • All notices and communications that DEUCE provides to you electronically (via email, in-app notifications, or messages within the Services) satisfy any legal requirement for written communication.

13. Third-Party Services

The Services may integrate with or contain links to third-party services, including but not limited to payment processors, mapping services (such as Google Maps), authentication providers (such as Google or Apple Sign-In), and app distribution platforms (Apple App Store, Google Play Store).

Your use of any third-party service is subject to that third party's own terms and conditions and privacy policies. DEUCE does not endorse, control, or assume responsibility for any third-party service and shall not be liable for any loss or damage arising from your use of such services.

14. Physical Activity and Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT PARTICIPATION IN RACQUET SPORTS (INCLUDING TENNIS, PADEL, AND PICKLEBALL) CARRIES INHERENT RISKS OF PHYSICAL INJURY, PROPERTY DAMAGE, AND OTHER HAZARDS. THESE RISKS INCLUDE, BUT ARE NOT LIMITED TO, SPRAINS, STRAINS, FRACTURES, HEAT-RELATED ILLNESS, CARDIAC EVENTS, AND INJURIES CAUSED BY EQUIPMENT, COURT SURFACES, OR THE ACTIONS OF OTHER PLAYERS.

BY USING THE SERVICES TO ARRANGE, PARTICIPATE IN, OR RECORD MATCHES, YOU VOLUNTARILY ASSUME ALL KNOWN AND UNKNOWN RISKS ASSOCIATED WITH YOUR ATHLETIC ACTIVITIES, WHETHER CAUSED IN WHOLE OR IN PART BY THE ACTION, INACTION, OR NEGLIGENCE OF DEUCE OR ANY OTHER PARTY.

DEUCE DOES NOT ASSUME RESPONSIBILITY FOR THE INSPECTION, SUPERVISION, PREPARATION, OR CONDUCT OF ANY MATCH, LEAGUE, OR ACTIVITY FACILITATED THROUGH THE SERVICES. YOU ARE SOLELY RESPONSIBLE FOR ASSESSING YOUR OWN FITNESS, HEALTH, AND ABILITY TO PARTICIPATE IN ANY PHYSICAL ACTIVITY.

The Services do not provide medical advice. You should consult a qualified healthcare professional before participating in any physical activity. If you experience any pain, discomfort, or other symptoms during or after a match, seek medical attention immediately.

15. Service Availability and Technology

The Services are provided over the internet and mobile networks and are subject to limitations, delays, and other problems inherent in the use of such communication technologies. DEUCE is not responsible for any delays, delivery failures, or other losses resulting from these inherent limitations, including but not limited to:

  • Internet or mobile network connectivity issues, latency, or outages affecting your ability to submit match results, access standings, or use in-app messaging;

  • Failures or malfunctions of your device, operating system, or browser that prevent normal use of the Services;

  • Delays in the processing or display of match results, rating updates, or standings calculations; and

  • Temporary unavailability of the Services due to scheduled or unscheduled maintenance, software updates, or server issues.

DEUCE will use reasonable efforts to maintain the availability of the Services but does not guarantee that the Services will be uninterrupted, timely, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice, for maintenance, updates, or any other reason.

Where a technical issue affects the recording of a match result, both players should re-submit the result or contact DEUCE support for manual resolution. DEUCE shall not be liable for any impact on standings or ratings caused by technical delays or failures beyond our reasonable control.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEUCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

DEUCE DOES NOT WARRANT THAT: (A) THE SERVICES WILL MEET YOUR REQUIREMENTS; (B) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE SERVICES (INCLUDING DMR RATINGS AND STANDINGS) WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN THE SERVICES WILL BE CORRECTED.

DEUCE DOES NOT ENDORSE ANY USER CONTENT AND SPECIFICALLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR ANY LOSS, DAMAGE, INJURY, CLAIM, OR OTHER CAUSE ARISING FROM OR RELATING TO ANY USER CONTENT POSTED ON THE SERVICES.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEUCE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.

DEUCE'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) TWO HUNDRED AND FIFTY MALAYSIAN RINGGIT (RM 250); OR (B) THE TOTAL FEES PAID BY YOU TO DEUCE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable Malaysian law.

18. Indemnification

You agree to indemnify, defend, and hold harmless DEUCE, its directors, officers, employees, agents, and affiliates from and against any claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of or access to the Services;

  • Your Content or any content you post, upload, or transmit through the Services;

  • Your athletic activities, including any match arranged or played through the Services;

  • Your violation of these Terms or any applicable law or regulation;

  • Your violation of any rights of another person or entity, including intellectual property rights and privacy rights; or

  • Any dispute between you and another member of the Services.

19. Termination

19.1 Termination by You

You may delete your account at any time through the app settings or by contacting us at support@deuceleague.com. Upon deletion, your account will be deactivated and your personal data will be handled in accordance with our Privacy Policy.

19.2 Termination by DEUCE

DEUCE may suspend or terminate your account and access to the Services at any time, with or without prior notice, for any reason, including but not limited to:

  • Breach or violation of these Terms, League Rules, or any applicable policy;

  • Conduct that DEUCE reasonably believes is harmful to other members, the Services, or the integrity of any league;

  • Requests by law enforcement or government agencies;

  • Extended periods of inactivity;

  • Discontinuance or material modification of the Services; or

  • Non-payment of any applicable fees.

For suspensions lasting longer than one league season or permanent bans, the procedural requirements in Section 5.6 shall apply, except where the suspension or termination is made at the direction of law enforcement or a government authority, or is a temporary measure of 14 days or less imposed to protect the safety or integrity of the Services.

19.3 Effect of Termination

Upon termination of your account:

  • Your right to access and use the Services will immediately cease;

  • Your DMR ratings and match history may be retained in anonymised or aggregated form for the purpose of maintaining league integrity and historical records;

  • Match results involving you that have already been confirmed will remain in the league records for the benefit of other participants; and

  • Any provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including Sections 6 (User Content), 9 (Intellectual Property), 14 (Physical Activity and Assumption of Risk), 16 (Disclaimer of Warranties), 17 (Limitation of Liability), 18 (Indemnification), and 20 (Dispute Resolution).

20. Dispute Resolution

20.1 Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Malaysia.

20.2 Good Faith Resolution

Before initiating any formal legal proceedings, the parties shall use their best efforts to resolve any dispute through good-faith negotiation. You agree to contact us at support@deuceleague.com and provide a written description of the dispute before pursuing any claim.

20.3 Jurisdiction

Subject to the good-faith negotiation process above, the courts of Malaysia shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. Nothing in this clause limits DEUCE's right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

20.4 Limitation Period

Any claim or cause of action arising out of or relating to these Terms or the Services must be commenced within two (2) years after the cause of action accrues. Any claim not brought within this period is permanently barred, to the extent permitted by applicable law.

21. General Provisions

21.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable League Rules, constitute the entire agreement between you and DEUCE with respect to the Services and supersede all prior agreements, understandings, and communications.

21.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

21.3 No Waiver

The failure of DEUCE to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by DEUCE.

21.4 Assignment

You may not assign, delegate, or transfer your rights or obligations under these Terms without DEUCE's prior written consent. DEUCE may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

21.5 No Partnership or Agency

Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and DEUCE. You have no authority to bind DEUCE in any respect.

21.6 Force Majeure

DEUCE shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, acts of government, internet or telecommunications failures, power outages, or civil unrest.

21.7 Language

These Terms are drafted in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.

21.8 Notices

DEUCE may provide notices to you via email, in-app notification, or by posting on the Services. Such notices shall be deemed effective upon sending or posting. You may contact DEUCE at:
